Terms and Conditions

By purchasing goods at Sulney Nursery you enter a legally binding agreement with us on the following terms. You should read and understand these terms because they affect your rights and liabilities.

 

ORDERS

Sulney Nursery endeavour to provide the best Customer Service possible.

All prices are subject to alteration without notice.

Prices quoted are subject to VAT and are valid for 30 days.

Items are offered subject to availability at time of order.

DELIVERY

Sulney Nursery will deliver within the East Midlands to distances within a 20mile radius of our Nursery.

All times and dates for delivery are given in good faith and the company will make its best endeavours to comply with them. 

Items will be delivered to the address kerbside or nearest access point if this is logistically possible and under the discretion of the delivery driver. If the owners are not home, plants may be left on a driveway area when granted by customer. A photograph will be taken by the driver as proof of delivery and will then be in the responsibility of the customer. Theft of the delivered plants will not be covered by a refund or replacement.

Delivery will be deemed as successfully made once the product has arrived at the address specified. A signature is required as proof of delivery and the goods received are of satisfactory condition.

Products will be deemed your responsibility once they have been received by you or the intended recipient. Risk of any loss or damage to the goods supplied will pass to the buyer on delivery or collection.

The buyer is responsible for the care of plants once collected or delivered.

Should delivery be refused at the delivery address, and re-requested for another date, Sulney Nursery will charge for the second delivery.

We carefully hand pick each plant but despite this, the loss of the odd leaf in transit is to be expected and will not damage a healthy plant.

If you decide to cancel an order or return a plant after the products have been delivered, you will be responsible for the return carriage costs of these products.

Any transportation costs for cancelled orders must be paid by the purchaser, except in instances where the goods supplied have been damaged in transport, have been supplied in error, or mis-described by the seller. Transportation costs will be charged when the goods supplied are as seen at the time of purchase.

DAMAGES AND RETURNS
We cannot be held responsible for the health of the plant after the plant has left our care and therefore, we do not guarantee any plants once the ownership has changed. Plant health is largely determined by external factors beyond our control, such as the availability of water, light and nutrients. We further undertake however that the plants will be in good condition at the time of purchase.

Sulney Nursery will require photographic evidence of the condition of the defected item. This includes close ups of the leaves, where it has been planted, the overall plant and the scene in which is is planed.

We won't replace or refund a plant if we think that it has died/suffered due to lack of water, nutrients, improper horticultural care or if the plant has been infected by an airborne pest or disease contracted from your garden or your neighbours. Plants will also not be covered when extreme weather such as drought, flooding, storms or snow affect the health of your plants.

It is the customer’s own responsibility to examine the goods on receipt and advise Sulney Nursery regarding any defects or shortages upon purchase. No complaints relating to defects or shortages apparent on such inspection will be accepted unless notified within 48 hours in writing from the date of delivery or collection.

Items that are not applicable for refund are: sale items, annual bedding and bulbs.

The maximum liability for plants supplied by the seller is limited to a refund of the purchase price, or to replacement of goods supplied. The seller will not be liable for any consequential losses or any other claim.

PERISHABLE ITEMS

We cannot be held responsible for the health of the plant after the plant has left our care and therefore, we do not guarantee any plants once the ownership has changed.

Sulney Nursery do not accept returns of plants that are not in the same condition in which they were delivered, including plants that have been planted, damaged, pruned, had any chemicals/feeds applied.

NON-PERISHABLE ITEMS

If the item has been damaged, used or is not returned in its original packaging, we reserve the right to withhold a percentage of the refund value if the item needs to be reduced in price for resale.

You can return non-perishable goods within 28 working days unused in its original packaging for a full refund.
